Limited Lifetime Warranty

NPGLOBAL (“We” or “Us”) provides Limited Lifetime Warranty coverage against defects in factory workmanship and materials for the NPGLOBAL Battery-Powered Backpack Sprayer (the “Product”) sold by authorized dealers for use by retail (end use) consumers (the “Limited Warranty”). This Limited Warranty is provided only to the original Product consumer, and applies only to the original installation. This Limited Warranty is not transferable and does not extend or apply to anyone else. Thus, this Limited Warranty lasts as long as the original Product consumer owns the Product. For consumers in the U.S.: this Limited Warranty gives you specific legal rights; you also may have other rights, which vary from state to state.

This Limited Warranty is the sole and exclusive warranty provided by Us, and all other warranties and conditions are excluded and disclaimed. We do not authorize any person to create any other condition or liability in connection with the Product.

Under the law of certain states, there may be no implied conditions or warranties from us applicable to your product, and all implied conditions or warranties (including any warranty of merchantability or fitness for a particular purpose) are excluded and disclaimed where allowed by law. If implied warranties are imposed under any applicable state law, all such implied warranties are limited to the duration of the applicable provisions of this Limited Warranty.

Exclusions

Certain items are excluded from Limited Warranty coverage by Us, and this Limited Warranty coverage does NOT apply to:

Wear and tear from normal use, including damage from drops, impact, or rough handling.
Improper product selection, application, set-up, storage, repair, or maintenance.
Modifications or alterations, including the attachment of non-NPGLOBAL parts, nozzles, or accessories.
Misuse, abuse, neglect, overfilling the tank, use with incompatible chemicals (e.g., solvents, petroleum-based products, or concentrated essential oils), or accidental damage.
Corrosion, freeze damage, or damage caused by environmental conditions or storage in temperatures outside the operating range.
The finish or cosmetic appearance of any Product.

Remedies Under This Limited Warranty

If a defect covered by this warranty occurs, We will repair or replace the Product, in our sole discretion. This “repair or replacement” remedy is the sole and exclusive remedy under this Limited Warranty.

We have no responsibility or liability for any indirect, special, consequential or punitive damages, such as loss of use of the Product, loss of time, replacement equipment rental, storage charges, labor and service charges for inspecting, removing, or reinstalling the Product or replacement parts, loss of or damage to chemicals, plants, lawns, or other personal property, emotional damage, interest or finance charges, or reasonable delay in performance under this warranty, all of which are specifically excluded and disclaimed from this Limited Warranty.

For consumers in the U.S.: some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Responsibility of Purchaser

The Purchaser must have proof of purchase to obtain service under this Limited Warranty. To make a warranty claim, contact Us at hello@proshopglobal.com or call or text 1-888-421-3737 from 8 am to 5 pm EST, Monday to Friday, identify the product by model number, and follow the claim instructions that will be provided. No Products will be accepted without prior authorization. Any returned Product that is replaced by Us becomes our property. You will be responsible for return shipping costs. Please retain your purchase receipt to verify date of purchase and that You are the original consumer purchaser. The product and the purchase receipt must be provided to Us to process Your warranty claim.

Assumption of Risk

You acknowledge and agree that any use of the Product for any purpose other than the specified use(s) stated in the product instructions is at Your own risk.

Waiver of Liability and Hold Harmless Agreement

We only make recommendations regarding product selection or use. The customer remains responsible for choosing the right product for the intended task, for selecting and mixing chemicals that are compatible with the Product, for following all chemical manufacturer label instructions and applicable laws, and for wearing appropriate personal protective equipment. You hereby agree to hold harmless, release, waive, and discharge us from any and all claims, actions, and judgments — including all costs of defense and attorney’s fees — incurred in defending claims in connection with product-use recommendations, chemical compatibility, or the application of any solution sprayed using the Product.

Governing Law and Venue

This Limited Warranty gives You specific legal rights, and You also may have other rights which vary from state to state. This Limited Warranty shall be governed by, and construed, interpreted and enforced in accordance with the laws of the State of Illinois, without regard to rules pertaining to conflicts of law. The state and federal courts located in Cook County, Illinois shall have exclusive jurisdiction for any disputes relating to this Limited Warranty.
